Terms and Conditions Agreement

Hamad Bin Abdullah Bin Sulaiman Almanea & Partners Trading Company, which is officially registered in the Kingdom of Saudi Arabia with Commercial Registration No. (1010129038) is a company specializing in selling and distributing electrical and home appliances and air conditioning. It has established this website (website + mobile application) to provide its services in the Sale and delivery of devices offered on the site and other services available through the site.

The terms, when mentioned in this agreement - terms and conditions agreement - mean the following:

Almanea Company or Company: Hamad Bin Abdullah Bin Suleiman Almanea & Partners Trading Company.

Customer: any person who uses the Website to purchase or benefit from its other services.

Website: Wherever mentioned in this agreement, it means “the online store of Almanea Company on the web + the electronic application of Almanea Company on mobile phones.”

Product or Products: Electrical and home appliances, air conditioners, and any other devices that are displayed by the company on the site.

Account: It is the record - the page - of the customer created in order for the customer to be able to benefit from the services of Almanea Company on the site and to have the ability to purchase and benefit from the services.

The user is the person whose personal data is entered into the account and is considered the real owner of the account.

First: Account registration conditions:-

1. You must be over 18 years of age if you are using the Site in the Kingdom of Saudi Arabia, or you must have reached the age of majority as provided by the laws of the country in which you are using the Site.

2. You must register on the site to be able to benefit from our services, and to complete the registration process you need to fill in the data accurately: writing the full name as it appears on your national ID, the current address of your residence, mobile number, and e-mail, and any required information as shown in the Registration page, - This information, will be confidential and will only be viewed by those authorized by the Company.

3. The company has the right, according to the powers granted to it in this agreement, to reject the request to create the account and it has no justification for the reason for the refusal. The company has the right to cancel or disable the account at any time whenever it appears that the owner of the account has entered wrong and incorrect information or finds to it, according to its discretion, that the account owner has violated the terms of use or something.

4. The company has the right to consider the e-mail address, phone number, and any other addresses belonging to the customer as an official means of communication and notifications, and through the notification, the argument is established to notify the customer.

5. The user is responsible for keeping their account data safe and must keep their password secure. The company is not responsible for any damages resulting from the negligence or failure of the user to maintain the security of the account and password.

6. The user is responsible for all activities and contents that are uploaded to the site through their account, such as data, graphics, images, and links, and he is responsible for any rights or infringement that arises from that. The user is also obligated not to upload or transmit any virus or any code of a destructive nature.

7. The user is responsible for the validity and integrity of their registered data and addresses and is responsible for the validity and integrity of the information of the credit cards and bank accounts that he entered.

8. A breach or violation of any provision of the Terms of Use will result in the disabling, termination, or deletion of the User account as the Company deems appropriate.

Second: Products: -

1. The products are displayed on the site and a description and an approximate picture of each product are provided, and we strive to achieve accuracy in describing and photographing the products, bearing in mind that an error or discrepancy may occur in the description or actual image of the products.

2. Displaying products on the site does not include a guarantee of their availability and the ability to deliver them to the customer, and the value of the purchased products will be refunded if they are not available.

3. The company is not responsible for any errors or malfunctions, and the responsibility lies with the official agent of the products sold.

4. The company does not include any information or descriptions of products that are not referred to on the site.

5. There may be differences in product prices between those displayed on the site and those in the company's branches.

Third: buying and selling services: -

1. The process of purchasing any of the products is confirmed by issuing an invoice from the site after the customer completes the payment of the value of the product or products that he wishes to purchase using one of the payment methods available on the site.

2. The customer has no right to withdraw from the purchase after completing the payment of the product value.

3. The company has the right to cancel the customer's order if he is more than one hour late in paying the value of the products through the SADAD payment system.

4. The company has the right to cancel the customer's order if the contact or delivery address is wrong, or if the customer is unable to reach him.

5. The company has the right to cancel the customer’s order if the customer is late in receiving the products from the showroom for more than 7 days if the order was paid (online) and the option of receiving was chosen by the customer (receiving from the showroom).

6. The company has the right to cancel the customer's order if he is late in paying the value of the products for 48 hours if the purchase option chosen by him was (payment and receipt at the exhibition).

7. The customer has the right to cancel the order if the products are not delivered on time, if there is a defect, or if the main and important specifications of the delivered product do not match what was mentioned in the product description on the site.

Fourth: Delivery and installation: -

1. The company provides home delivery service without fees for large-sized products, such as washing machines, dryers, dishwashers, refrigerators, freezers, ovens, televisions of 60 inches or larger, in addition to home theater equipment, only in Riyadh, Jeddah, Dammam, and Al-Kharj.

2. The delivery process takes place to the address specified by the customer on the site, which must include the following information (S The person concerned-phone number-city-street name-neighborhood-building number, villa number, or apartment number - zip code).

3. The customer bears full responsibility for their mistake in specifying the correct delivery address, and the company is not responsible for any consequences caused by this error, including but not limited to (delivering products to people other than the customer - and others).

4. After the products arrived at the location specified by the customer and could not be received due to the customer’s failure to respond to the delivery representative’s communication, or because of the wrong address specified, in this case, the company has disclaimed its responsibility to complete the delivery and the customer is liable to pay an additional cost determined by the company to re-deliver the product or coordinate with Customer service in the company to come and receive the product from the headquarters specified by the company to receive the products.

5. After receiving the products, the customer must open and operate them, and ensure that they are free from defects, fractures, and others before the representative leaves. The representative’s departure after the customer receives the products and the customer does not object to the presence of any defect in the products is considered an acknowledgment by the customer of the validity of their receipt of all the products specified in the invoice. And that it works properly and is free from all defects, and he is not entitled to object or pay in any way whatsoever for the existence of defects, breakages, or defects in the products.

6. The products are delivered through the company or one of the delivery companies that the company agrees with during working days (from Sunday to Thursday), according to the following details:

- Small products (less than 30 kg):

a. Delivery: 15-20 business days

B. Cost: Free for orders over 349 SAR | Cost 28.75 SAR for orders less than 349 SAR | An additional cost of 23 SAR will be added to the payment service upon receipt.

- Large products, including air conditioners:

a. Delivery is available to Riyadh, Dammam, Jeddah, and Al-Kharj and takes 15-20 working days.

B. The installation of split air conditioners shall be within 25 working days.7. The limit allowed for product delivery is the second floor as a maximum.

8. The delivery times and costs referred to above are approximate and may be increased or decreased, and the company does not bear any responsibility due to the change in delivery costs or the delay in the dates from the above decision.

9. The company has the right to refuse to deliver products to anyone under the age of 18.

10. An additional fee, estimated by the company, will be charged at the time of delivery outside the following cities (Riyadh-Dammam-Jeddah-Al-Kharj).

11. Communication takes place with the customer to confirm the date of delivery of the products and the date of their receipt according to the communication mechanism that the company decides, whether through the website or by communicating via WhatsApp, calling, text messages, or anything else that the company decides as a method of communication with the customer.

12. The customer must provide the place for installing air conditioners with all the required equipment (plumbing - electricity - a hole in the concrete - clearing the installation place of previously installed air conditioners, if any). Defects or obstructions in the place of installation.

13. The guarantee of the installation of air conditioners is three months from the date of installation, and the company does not bear any responsibility for the failure of the air conditioners that it installed, if the reason is the place of installation or the connections that the customer has, or other things related to the customer and the place of installation.

14. Each air conditioner shall have one hole in addition to the copper provided by the authorized agent of the device, and if the customer needs an increase in copper wires or any other needs for installation, including but not limited to (air conditioner chairs – ribs – a crane to connect the air conditioner to the roof - and others) then he shall bear The customer provides it, or if the company wishes to provide the service, the customer will have to pay additional costs according to the pricing decided by the company at the time.

15. When requesting the installation of a window air conditioner, the customer must make the location of the air conditioner free from the presence of a previous air conditioner or something else, that there be a wooden frame, and that the height of the air conditioner opening does not exceed 3 meters from the surface of the ground, and that there is electricity directly next to the air conditioning opening, and the company has the right Refrain from installation when none of the aforementioned is available.

16. The customer is responsible for installing air conditioners in locations that violate safety requirements.

17. Fast delivery:

• Same-day delivery when ordered before 5 pm.

• The service is available on selected items marked with the same-day delivery logo in the application and online store.

• We provide service in specific cities and neighborhoods to ensure you get the best quality and speed.

• The service is available in major cities Riyadh, Jeddah, and Dammam.

• The service costs only 20 riyals for bills less than 299 riyals.

• The service is valid all days of the week except Fridays and official holidays.

• To implement the service, you must choose the same-day delivery option when adding the shipping address.

• Sometimes it may not be possible to implement the fast delivery service, in which case the delivery is automatically converted to a regular delivery according to the periods available on Almanea Company’s self-service platform.

Fifth: the guarantee: -

1. The warranty of the products sold by the manufacturer or an authorized agent for a period of two years from the date of purchase.

2. The guarantee is the guarantee of the agent and not the guarantee of the company, so any claim by the customer related to the products or the guarantee goes to the authorized agent for the products and not to the company.

3. The guarantee shall be forfeited by the loss of the original invoice for the products issued by the company.

4. The customer must read the instruction booklet attached to the product to see how the product works and operates and to verify its compliance with safety and security standards and local electrical requirements.

5. All products sold by the company are designed to operate on a range (220-240 volts) unless otherwise specified, and if the product is damaged due to its operation other than using the specified voltage, it will not be subject to replacement, refund, or warranty of the agent.

Sixth: Payment services: -

1. The customer must write down - on the payment page - correct and valid credit card information (Visa / Master Card), or data of any other payment method available on the site or application.

2. It is prohibited for the customer to defraud using an incorrect or invalid payment method, and it is also prohibited to use a stolen payment method, and the customer bears responsibility as a result of violating this paragraph.

3. The company will, through an electronic payment intermediary, deduct the value of the purchases from the credit card or the payment method approved by the customer.

4. The customer issuing the purchase order is an authorization from him that the company is entitled to deduct the value of the purchases.

5. All purchases are made in Saudi riyals, and all payments must be in the Saudi currency, if the customer pays using another currency, he will bear the expenses and wages incurred in currency conversion or any other bank fees.

6. The Client grants the Company the right to provide Za, MasterCard, or any payment service provider with their credit or bank card data.

7. The company may ask the customer for their personal identification number for the purposes of verifying the validity and integrity of the credit card or bank account, or verifying the validity of the data of any other payment method.

8. It is the customer's responsibility to activate any payment method made through their account.

Seventh: Retrieval and replacement: -

1. The customer has the right only within (7 days) to return the products if the main and important specifications of the product do not match what was mentioned in its description on the site.

2. The customer has the right only within (7 days) to submit a request to return the products due to a defect, and at that time the company will contact the authorized agent for the products to send a technician to inspect the products for the customer and prepare a report for the company on the condition of the products, and the customer will have to follow up with the agent if the defect is verified And the defect to return the products and compensate for them or as decided by the agent.

3. In the event that the products are returned due to a defect in the product or as a result of damage caused by the company through the delivery of the product, the company will bear the fees for transferring the amounts to the customer.

4. If the products are returned due to the customer's unwillingness or for any other reasons pertaining to the customer, the customer will bear the return fees.

5. In the event that the products are returned by the customer after delivery and the reason for the return is because the customer does not want the product or for other reasons related to the customer, the customer will be charged the value of loading and unloading at a rate of (2%) of the invoice value with a minimum of (100 riyals).

6. It is required to accept the return of any product that it is within (7 days) from the date of purchase, and that the product is in its original condition that has not been opened or used with all the accessories, the accompanying instructions booklet, and the original packaging, and that the products and their packaging are free from scratches, malfunctions or any other damages that cause in which the client.

7. The following conditions are required to return mobile phones, computers, tablets, digital and professional cameras:

a. The return and exchange must be within (24 hours) from the date of purchase.

B. Bring the original purchase invoice and exit stamp.

C. The product must be in the same condition when purchased and wrapped in the original packaging and has not been opened or used.8. Software and video games cannot be returned or exchanged.

9. It is not allowed to return or replace health and beauty products (shaving and hair removal devices - oral and dental health care devices - and other health, beauty and personal care devices) unless there is a manufacturing defect, in which case the customer has the right to return or exchange within (7 days) only.

10. It is not allowed to return or replace printers, faxes, photocopiers, and any other supplies or accessories unless there is a manufacturing defect, in which case the customer has the right to return or replace within (7 days) only.

11. Gift items cannot be returned or exchanged.

12. The customer is not entitled to exchange, return or refuse to receive the product if the product model approved by the Standards and Metrology Authority has expired, due to the customer's inability to resell the product to another customer.

Eighth: General Provisions: -

1. The official communication takes place through notifications sent to the customer on their account on the site or on the customer's address written in their account. The customer's use of the previous means is considered an argument in informing the customer.

2. The terms and conditions agreement or part of it may be amended at any time, and the amended version will be published on the site, and the amended version of (the terms and conditions agreement) will be effective after seven days have passed from the date of its publication, and after publication, your continued use of the site is considered a commitment from you With the terms and conditions contained in the amended version of the Terms and Conditions Agreement, and your satisfaction with the provisions of the amendments.

3. The laws and regulations of the Kingdom of Saudi Arabia apply to the provisions of this agreement, and the competent judicial authority in the city of Riyadh is competent to hear any dispute that arises or arises as a result of this agreement and its contents and the actions arising from it.

Ninth: Provisions of discounts for bank cards: -

1. The offer does not apply to Apple Pay, Mada Pay, or any similar payment method purchases.

2. The offer does not apply to Tabby or Tamara's purchases.

Tenth: conditions and provisions of the annual festival:-

1. Buy one device and get another device for free from a selection of selected items (The offer applies to the lowest-priced device)

2. Delivery and installation during the available periods on the Almanea platform to the following cities: (Riyadh - Al-Kharj - Al-Majma'ah - Al-Qassim, including the cities of Buraidah, Unayzah, Al-Rass, Al-Bukayriyah, and Al-Bada'i - Dammam - Al-Khobar - Al-Ahsa - Jeddah - Mecca - Medina - Taif) during the festival period.

3. The customer schedules the delivery and installation date through the sent message or scanning the code <<<

4. Delivery of the invoice to one location only (one home only)

5. per customer only one offer from the 1+1 offer for each product.

6. In the case of return, it will be after the end of the festival period, and the return will be in the case of 1+1 for all of the two items.

7. Quantity sales are prohibited.
